Barcelona’08

Last 3rd October, a Seminar in Barcelona was held about the fight against late payments in the European context and the new procedure of European order of payment.

On 12 December 2008, the new procedure of European Order of Payment, created by the regulation 1896/2006 will be applicable. The AEA-EAL, following its spirit of approaching the latest in European Law to the lawyers of the Old Continent, and into the context of the Procedural Sessions to be hold regularly in Barcelona, wanted to use the opportunity to deeply analyse this new procedural tool, which will certainly have a prime place in the fight against trans-national late payments, especially in the present situation of economical crisis.

To be able to provide the best lecturers, Professor in Procedural Law and Former Dean of the Barcelona Bar, Pr. Dr. Jaime Alonso-Cuevillas, organized the scientific programme.

Mr. Luis Sales Camprodón, Former President of AEA-EAL and current member of the Council of the Bar of Barcelona opened the working sessions.                                                                >>>

<<< The first lecture was held by Professor Dr. Juan Correa Delcasso, exposing the The European politics on the fight against late payments. Pr. D. Juan Correa reviewed the different Treaties and Rules in the European Union, concluding that late payments are an obstruction to the correct work of the internal market.

Next, Magister Alberto Mata Sáiz entered more precisely into the Order of Payment, as the text of the law try to avoid expenses, and simplify procedure, for claims without opposition, introducing a procedure of Order of Payment. This Law enables the free movement of debt claims between Member States, trough the implementation of some simple rules avoiding an intermediate procedure before recognition or execution.                                                               >>>

<<< Following to a kind lunch, Mr. Jesus Sánchez García and Frederic Munné were the leaders of two roundtables about national rules about the order of payment and about the arbitration as a way to avoid the lack of payments. Ms. Monica Díaz and Ms. Marian Dickstein,

M. Michal Lachert and Michel Forges participated on the roundtables.

The working session concluded with the lecture of Ms. Pr. D. Elisa Escolà, who exposed the principles of the international insolvency procedure and the coordination problems between member States, to avoid delays on payments.                                                               >>>

In spite of the little participation, the Seminar was very satisfying for the participants, who participated very actively.
